WarPulse Lightning API

This End User License Agreement ("Agreement") is a legal contract between you ("Licensee," "you," or "your") and WarPulse LLC ("WarPulse," "we," "us," or "our") governing your access to and use of the WarPulse Lightning API, including all associated data, documentation, endpoints, and services (collectively, the "API"). By registering for an account, obtaining an API key, or making any request to the API, you agree to be bound by this Agreement. If you do not agree, you must not access or use the API.

Subject to the terms of this Agreement and timely payment of all applicable fees, WarPulse grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the API solely in accordance with your Plan, this Agreement, and any applicable documentation.
This license does not convey any ownership interest in the API, the Lightning Data, or any intellectual property of WarPulse.
Your rights to use the API for Commercial purposes depend on the Plan you have subscribed to. These restrictions apply regardless of the volume of data consumed or the number of API keys held.
Starter Plan — Non-Commercial Use Only
The Starter Plan is licensed for personal, educational, research, and non-commercial development purposes only. You may not use the API or any Lightning Data obtained under a Starter Plan in any product, service, or context that generates revenue or is intended to generate revenue. This includes prototypes or beta products that will later be monetised. If your use becomes commercial, you must upgrade to the Pro Plan or above before the commercial use begins.
Pro Plan — Commercial Use Permitted
The Pro Plan includes a license for Commercial Use, subject to the restrictions in Sections 4 and 5. You may integrate the API into revenue-generating Applications, provided that you do not resell or redistribute the raw Lightning Data as a standalone data product.
Ultimate Plan — Full Commercial Use Permitted
The Ultimate Plan includes the broadest commercial license available under this Agreement. You may use Lightning Data in high-volume, revenue-generating Applications and may redistribute derived or processed data (not raw API output) as part of your own products, provided attribution requirements in Section 6 are met.

Regardless of Plan, you may not:
Lightning Data is sourced from WarPulse's proprietary data pipeline and is provided on an as-is, as-available basis. WarPulse does not guarantee the accuracy, completeness, timeliness, or fitness of the data for any particular purpose. Infrastructure outages, coverage gaps, and processing latency may affect data availability without notice.
The Lightning Data must not be used as the sole basis for safety-critical decisions, including but not limited to aviation routing, marine navigation, wildfire prediction, or emergency dispatch. You assume all risk arising from reliance on the data.
Where your Application displays Lightning Data to end users, you must include a visible attribution to the data source. Acceptable forms include:
Attribution may be omitted in internal tooling, back-end processing pipelines, or Applications where data is not displayed directly to users, provided the underlying source is documented in your internal records.
Your access is subject to the rate limits and daily call quotas of your Plan. Exceeding these limits may result in request throttling or temporary suspension of your API key. Systematic attempts to exceed limits, share keys across multiple users, or otherwise abuse the API may result in immediate account termination without refund.
WarPulse reserves the right to adjust rate limits with reasonable notice. For enterprise-scale usage, contact us to discuss custom arrangements.
Access to the API requires a paid subscription. All fees are billed monthly through Stripe. You authorise WarPulse to charge your payment method on a recurring basis. Failure to maintain a valid payment method will result in suspension of API access. Fees are non-refundable except where required by applicable law.
WarPulse may change subscription pricing with at least 30 days' notice. Continued use of the API after the effective date of a price change constitutes acceptance.
This Agreement begins when you first access the API and continues until terminated. Either party may terminate at any time: you by cancelling your subscription and ceasing use; WarPulse by providing written notice if you materially breach this Agreement or if your subscription lapses.
Upon termination: your API keys will be revoked, your license to use the API and Lightning Data ceases immediately, and you must delete any cached Lightning Data you hold unless an alternative arrangement is agreed in writing. Sections 4, 5, 6, 10, 11, and 12 survive termination.
The API, its software, infrastructure, data pipeline, and all WarPulse trademarks are owned by WarPulse LLC. All Lightning Data, processing methods, and service infrastructure are proprietary. Nothing in this Agreement transfers any intellectual property rights to you.
THE API AND ALL LIGHTNING DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. WARPULSE DOES NOT WARRANT THAT THE API WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WARPULSE LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE API, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL WARPULSE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE FEES YOU PAID TO WARPULSE IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE CLAIM.
This Agreement is governed by the laws of the State of Indiana, United States, without regard to its conflict of law provisions. Any dispute arising under this Agreement shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in Indiana. Notwithstanding the foregoing, either party may seek injunctive relief in any court of competent jurisdiction to prevent irreparable harm.
WarPulse may update this Agreement from time to time. We will notify you by email or via the developer dashboard at least 14 days before material changes take effect. Continued use of the API after the effective date of any changes constitutes your acceptance of the revised Agreement. If you do not agree with the changes, you must cancel your subscription and cease use before the effective date.
This Agreement, together with the WarPulse Terms and Conditions and Privacy Policy, constitutes the entire agreement between you and WarPulse LLC regarding the Lightning API and supersedes all prior agreements or understandings. If any provision of this Agreement is found to be unenforceable, the remaining provisions remain in full force.
